Law‑Enforcement Request Policy for BAQS, Inc.

Scope. This policy explains how BAQS, Inc. (“BAQS”) handles requests from government authorities for user data under U.S. law (e.g., the Electronic Communications Privacy Act, including the Stored Communications Act). It does not provide access to Inbaqs systems and does not apply to private/civil requests (see below).

1) Where to serve requests

Please include a return email, phone, agency, badge/ID, and the legal instrument.

2) What we require

We disclose user content (e.g., email bodies/attachments) only with a valid search warrant.

We disclose non‑content records (e.g., subscriber info, login logs) only with a subpoena or court order as authorized by law.

Requests must be narrow (specific identifiers, date ranges, data types). We may challenge overbroad or improper requests.

3) User notice

We notify the customer (workspace owner/admin) before disclosure to allow them to seek legal remedies unless: (a) the law prohibits notice (e.g., a valid nondisclosure order), (b) there is an imminent risk to life or safety, or (c) notice would be futile (no valid contact). If notice is delayed by court order, we will notify when the order expires.

4) Preservation

We accept preservation requests under 18 U.S.C. § 2703(f). Unless otherwise specified, we preserve for 90 days, renewable upon written request. Preservation is not disclosure; a valid legal process is still required to obtain content or records.

5) Emergencies

BAQS may disclose limited information without legal process when we, in good faith, believe that an emergency involving danger of death or serious physical injury requires immediate disclosure (18 U.S.C. § 2702(c)(4)). Use the subject line “EMERGENCY REQUEST” and describe the nature of the emergency and the specific data needed.

6) International requests

BAQS is a U.S. company. For non‑U.S. authorities, please use the appropriate mutual legal assistance process or obtain U.S. legal process.

7) Cost reimbursement

Where permitted by law, we may seek cost reimbursement for processing time, media, and delivery.

8) Data availability & retention

We only retain data per our standard retention policies and customers’ settings. If data is deleted before we receive a valid request, we cannot produce it.

9) Civil/Private requests

We do not disclose user content to private parties. Serve the customer directly or obtain a court order consistent with applicable law.
